Responsibilities connected with delegating a foreigner

In Niden we deal with delegating workers from Poland as well as foreigners to other European countries, especially the Netherlands.

Workers delegated to the Netherlands are entitled to the general employment conditions in force for that country. In sectors where a collective labor agreement is in force, delegated workers also have the right to base employment conditions in force for a given collective labor agreement.

In Niden we comprehensively provide services for our Clients – starting with worker recruitment, transport organization, accommodations, managing our personnel at a foreign company, preparation of the appropriate documents, as well as notifying the appropriate offices about workers delegated to the Netherlands.

Working conditions and remuneration of foreign workers

Answer

The working conditions offered to foreigners generally do not differ from the remuneration offered to Polish workers. Their pay depends on the pay policy or remuneration regulations of a given company. Its amount most often also depends on the level of education, experience, and knowledge of Polish.

In many industries workers from abroad fill out the gap left because of the lack of Polish workers. A doubtless benefit of employing foreigners is the fact that statistically they are more tied to their employer (often also due to the process of employment legalization) and they can fill vacancies in which the employment of national workers is extremely difficult and sometimes even impossible.

Social welfare and health contributions of a foreign worker

Answer

The Act on social welfare in no way makes the payment of social welfare contributions dependent on citizenship. This means that foreigners are subject to the same contribution regulations as Polish workers.

Tax residency and advance income tax payments of a foreigner

Answer

Tax residency is simply put a situation where a given person in a given country has all his income taxed regardless of the source of this income. This means that as a rule, a person pays taxes in the country of his/her residency.

In Poland, it is assumed that tax residency covers all people who have their personal or economic center of interest (center of vital interests) in Poland or reside in Poland for more than 183 days in a fiscal year.

In practice, this means that for people who do not meet the above-mentioned criteria, a limited tax liability applies pertaining only to income earned in Poland.
