  1. General information

This document sets out the rules for the processing and protection of personal data provided by Users in connection with the use of the website www.niden.pl   and applies to all cases in which Niden Contracting Sp. z o. o. is the Personal Data Administrator. The document was created to ensure full and transparent implementation of the information obligation arising from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR). The document contains the rules for collecting and using User data applicable on the Website. In order to ensure data integrity and confidentiality, the Administrator has implemented procedures enabling access to personal data only to authorized persons. The Administrator takes all necessary actions to ensure that its subcontractors and other cooperating entities guarantee the use of appropriate security measures whenever they process Personal Data on behalf of the Administrator.

  1. Scope of processed data

The processing of personal data is, in principle, any activity involving personal data, regardless of whether it is performed in an automated manner or not, e.g.: collecting, storing, recording, organizing, modifying, viewing, using, sharing, limiting, deleting or destroying . Personal data is processed only in cases where you have consented to it, or when the Administrator has another legal basis allowing him to process your personal data.

The storage period of personal data depends on the purpose of data processing for which they were collected. The criteria used to determine the appropriate retention period include:

Niden Contracting Sp. z o. o. applies the principle of limiting the storage of personal data, which protects the data against processing for a period longer than necessary for the purposes for which the data are processed. When the company completes the purpose of processing, it deletes or anonymizes the data, which occurs in particular when:

  • you withdraw your consent to the processing of personal data for recruitment purposes;
  • in the case of correspondence, data will be stored for a period of 6 years until the proceedings are completed, until claims cease or our obligations under the law cease;
  • if you use our social media, data will be stored for the duration of your profile or until you stop following it. The data constituting the content of correspondence may be processed for a period of 6 years from the end of the proceedings or until the claims cease;
  • if you use the chat function on the website, the data will be stored for a period of 6 years until the proceedings are completed, until claims cease or until our obligations under the law cease;

  1. Recipients of personal data

In connection with running a business that requires the processing of personal data, data may be disclosed to our subcontractors who help us perform specific tasks and provide selected services. Personal data may be made available primarily to employers for the purpose of employment or further stages of recruitment. Data may be disclosed only within the scope of services provided to us, in particular to companies of the Niden group, entities providing maintenance, advisory, consulting, legal and accounting services, IT services and hosting service providers. 

Do we transfer your data to third countries?

As part of recruitment processes and promoting our business, we have accounts on Facebook, Instagram (Meta) and LinkedIn.

Using the functionalities offered by Meta and LinkedIn requires the transfer of data outside the European Economic Area. In such a case, data may be transferred to third countries in accordance with the rules of these social media. These entities have joined the Data Privacy Framework, which guarantees an appropriate level of personal data security.

The use of other functionalities offered by the portals is based on the principles described in their regulations.

By choosing a form of contact outside the channels officially indicated on the website by Niden, you are acting based on your own will, and the company is not responsible for the security of data you voluntarily provide through such channels.

  1. Rights of data subjects

Everyone who provides us with their personal data has the opportunity to choose the extent to which they want to use our services and what information about themselves they want to share. We also inform you that at any time you have the right to request the Administrator to exercise your rights in accordance with the applicable provisions of the Personal Data Protection Regulation. You have the following rights:

The right to access personal data relating to yourself - on this basis, the Administrator provides the natural person submitting the request with information about data processing, including, in particular, the purposes and legal basis for processing, the scope of data held, the entities to which it is disclosed and the planned date of deletion. data;
  2. The right to rectify data - the Administrator is obliged to remove any possible inconsistencies or errors in the processed Personal Data and supplement them if they are incomplete;
  3. The right to delete data - on this basis, you can request the deletion of data whose processing is no longer necessary to achieve any of the purposes for which it was collected;
  4. The right to limit processing - if such a request is made, the Administrator ceases to perform operations on Personal Data - except for operations to which the Data Subject has consented - and to store them, in accordance with the adopted retention principles;
  5. The right to transfer data - the data subject has the right to receive personal data concerning him or her that he or she provided to the Administrator in a structured, commonly used, machine-readable format, and has the right to send this data to another Administrator;
  6. The right to object to data processing - The data subject may at any time object - for reasons related to his or her particular situation - to the processing of Personal Data which is carried out on the basis of the legitimate interest of the Administrator; the objection in this respect should include a justification;
  7. The right to withdraw consent - if data are processed on the basis of consent, the Data Subject has the right to withdraw it at any time, which, however, does not affect the lawfulness of the processing carried out before its withdrawal;
  8. The right to lodge a complaint - if it is considered that the processing of Personal Data violates the provisions of the GDPR or other provisions regarding the protection of Personal Data, the Data Subject may submit a complaint to the authority supervising the processing of Personal Data competent for the place of habitual residence of the Data Subject, his place of work or the place where the alleged infringement occurred.

Where we use contractors' services, your personal data remains under our control and we have procedures in place to ensure that your personal data is properly protected.

Cookies are IT data files that perform a very important function, facilitating the use of the Internet, allowing for better, faster, safer and more convenient use of it.
